Terms of Service

Last updated September 20, 2026.

Summary (not a substitute for the terms below)

This is a plain-language summary. The numbered sections below are what actually governs.

  • OakTend is run by OakTend LLC, a California limited liability company. Our mailing address is 2108 N Street, Suite N, Sacramento, CA 95816. You must be eighteen (18) or older and use OakTend for a property in Orange County, California.
  • OakTend is a platform, not a contractor. We connect homeowners and independent pros. We are not a party to any job and we do not employ pros. When in-app payments open, a homeowner pays the pro's invoice through the app, using Stripe, after the work is done. The money goes from the homeowner to the pro. OakTend never holds it.
  • OakTend is in a homeowner preview. The Pro side is not open yet, everything is free, memberships show as coming soon, and no payment of any kind is taken. During the preview our team may look by hand for a local pro for a job you post. We cannot promise to find one, and we do not vet or guarantee any pro. Read "Finding a pro during preview" in section 2.
  • "License verified," "insurance," and "background check" are trust signals with specific, limited meanings. Read section 5 before you rely on any of them.
  • Ask OakTend is an AI assistant, not a person and not a licensed professional. Its answers, including cost estimates, are not professional advice.
  • Nothing can be bought during the preview. When memberships open, paid plans will auto-renew until you cancel, you will be able to cancel online in the app at any time, and there will be no partial refunds on subscriptions. When the Pro side opens, pros pay a 5% success fee (minimum $15, capped at $1,000) only when a homeowner hires them through the app; there are no upfront lead fees.
  • Most disputes go to individual arbitration, not court, and you waive the right to bring or join a class action. You can opt out within thirty (30) days of first accepting these terms. Read section 18 carefully.
  • Our liability to you is capped at the greater of $100 or the amounts you paid to us in the 12 months before the claim, except where California law does not allow that.
  • Pros also agree to a separate Pro Terms of Service covering leads, billing, and CRM use. If you are a pro, both documents apply to you.

1. Agreement, who we are, and eligibility

These Terms of Service (these "Terms") are a contract between you and OakTend LLC, a California limited liability company ("OakTend," "we," "us," or "our"). Our mailing address is 2108 N Street, Suite N, Sacramento, CA 95816. By creating an account, checking the signup consent box, or using OakTend, you agree to these Terms and to our Privacy Policy.

To use OakTend, you must:

If you are a pro, you also agree to the separate Pro Terms of Service, which governs jobs and the success fee, subscription billing for pro plans, and your use of the client management tools. Where the Pro Terms of Service address a topic specifically for pros, that document controls for pros on that topic. These Terms still apply to pros on everything else, including account rules, content rules, AI features, and dispute resolution.

2. What OakTend is, and what it is not

OakTend is a software platform. It helps homeowners track home maintenance, home systems, photos, and documents, and it connects homeowners who post jobs with independent pros who apply to do the work.

OakTend is not a contractor, is not a party to any home improvement contract, and does not perform, supervise, or guarantee any work. We do not employ pros, and no pro is our agent or joint venturer. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between OakTend and any user.

When a homeowner hires a pro through OakTend, the resulting contract is between the homeowner and the pro. The homeowner pays the pro. When in-app payments are available, that payment is made through the app after the work is done and is processed by Stripe, and it goes from the homeowner to the pro's own Stripe account. OakTend is not the seller of the work, does not hold the payment at any point, and does not hold funds in escrow for a job. No in-app payments are available during the preview. OakTend does not verify the quality, safety, timeliness, licensing status beyond the point-in-time check described in section 5, or outcome of any pro's work.

Finding a pro during preview

OakTend is in a homeowner preview and the Pro side is not open yet. You can still post a job. It is saved to your home's record, and while the preview lasts our team may look by hand for a local pro who could do the work.

Please read this part closely:

Once the Pro side fully opens, pros will apply to posted jobs in the normal way and this preview process ends.

3. Accounts and security

You agree to give us accurate information when you create an account and to keep it current, including your name, contact details, and property address. You are responsible for everything that happens under your account.

You can sign up and sign in with email and password, with Google, or with Sign in with Apple where that feature is enabled. If you use a third-party sign-in provider, that provider's own terms and privacy practices also apply to your use of their service.

Keep your password and any device you use to access OakTend secure. Tell us right away at security@oaktend.com if you believe your account or credentials have been compromised, lost, or used without your permission. We are not responsible for losses caused by your failure to keep your account secure, but we will help you recover it and will investigate reports of compromise.

4. Homeowner use of OakTend

If you use OakTend as a homeowner:

5. Trust signals, explained exactly

OakTend shows a small number of trust signals on pro profiles and job boards. Each one means exactly what is described here, no more:

We do not use, and do not plan to add, marketing labels like "vetted," "trusted," "best," or "guaranteed" for any pro or homeowner. If you see such a claim anywhere in the app, it does not reflect an actual OakTend review process, and you should not rely on it; tell us and we will correct it.

6. Ask OakTend and other AI features

Ask OakTend is an AI assistant built on Anthropic's Claude models. It can answer home maintenance questions, suggest tasks, give rough cost estimates, and analyze documents or quotes you upload.

Read this carefully:

7. Home value and cost estimates

Any home value estimate, cost estimate, or "what this might run" figure you see on OakTend, whether generated by Ask OakTend or by our static appreciation and cost tables, is a rough estimate only. It is not an appraisal, not a quote, and not a substitute for a licensed appraiser's opinion or a pro's actual bid. Do not rely on these figures for a financial, insurance, tax, or legal decision. Get a professional opinion for anything that matters.

8. Messaging, reviews, and your content

Your content stays yours. Everything you upload or post, including photos, job descriptions, documents, in-app messages, and reviews, remains your property.

License you give us. To operate OakTend, you grant us a non-exclusive, worldwide, royalty-free license to host, store, copy, reformat, and display your content, and to share it with the people a given feature is meant to reach, for example showing your job photos to pros you invite to bid, or publishing a review you chose to post. This license exists only so we can run, secure, and improve the service. It ends when you delete the content or your account, except for copies we must keep in backups or for legal or accounting reasons, and except where someone else already relied on it, such as a review already published or a photo already sent to a pro.

De-identified and aggregated data. You also grant us a perpetual, worldwide, royalty-free license to create de-identified and aggregated data from the information you and your home generate on OakTend, and to use, publish, and license that de-identified data for any lawful purpose, including maintenance benchmarks, service-life statistics, market research, and product development. De-identified means the data has been produced as described in our Privacy Policy: your name, address, contact details, document contents, photos, and chat contents are never included, and the data is grouped so that no individual home is identifiable. We will not attempt to re-identify de-identified data, and we require anyone who receives it to agree to the same restriction, including a ban on reselling it or passing it to anyone else except under identical terms. This is not a sale of your personal information.

You are telling us you have the right to post what you post. Do not upload someone else's copyrighted work, trademarks, or private information without permission, and do not upload anything illegal or deceptive.

Reviews. Only a homeowner who chose a pro for a job may review that pro for that job, and only one (1) review per job. We never pay for reviews, never write them for anyone, and never remove a review because it is negative. We only remove a review for a genuine guideline violation, such as profanity, off-platform contact information, harassment, content unrelated to the job, or evidence that it is fake. We plan to let a pro post one (1) public response under a review. Until that is available, a pro can ask us to look at a review by writing to support@oaktend.com. This approach is consistent with the FTC's Consumer Reviews and Testimonials Rule (16 CFR Part 465): we do not suppress honest reviews and we do not condition anything on a review's sentiment. See our Community Guidelines and Reviews Policy for the full rules.

Moderation. We may remove or restrict content at any time if we believe it violates these Terms, our Community Guidelines, or the law. We are not obligated to monitor content before it is posted, and we are not responsible for content other users post. Content posted by another user belongs to them, not to us, and we do not endorse it. This section reflects our reliance on the legal protections available to platforms that host user content, including 47 U.S.C. Section 230.

No circumventing the platform. Do not use messages, reviews, profiles, or job posts to share contact information for the purpose of moving a relationship off OakTend to avoid fees that would otherwise apply, and do not harass, threaten, or abuse another user through any feature. If someone infringes your copyright, use our DMCA process; see section 12.

9. Paid features

Preview period. OakTend is in a homeowner preview. The Pro side is not open to new signups. Homeowner paid features are free, memberships show as coming soon and cannot be bought, and no charge of any kind is made. We will tell you by email and on this page before that changes. The prices below describe what we plan to offer when memberships open.

When memberships open, we plan to offer Homeowner Plus as a paid subscription at $1.99 per week, $4.99 per month, or $39.99 per year, with a three (3)-day free trial. Your payment method will be charged automatically when the trial ends, unless you cancel first, and the subscription will then renew automatically at the price shown for the plan and interval you chose. You will see the price and these renewal terms, and be asked to agree to them, before any charge.

You will be able to cancel online at any time from your membership page in the app, or through the Stripe billing portal. Canceling stops future renewals; you keep access through the end of the period you already paid for. We do not give partial refunds for the unused part of a billing period.

If we ever raise the price of an active subscription, we will give you at least thirty (30) days' notice by email before the change takes effect, and it will apply starting at your next renewal after that notice.

Our full Billing & Refund Policy, published separately, is the controlling document for billing mechanics, the pro success fee, account credit, and chargebacks. Where anything in these Terms and the Billing & Refund Policy appear to conflict on a billing detail, the Billing & Refund Policy controls.

As required by California Business and Professions Code section 17538, before you complete a purchase we will display OakTend LLC, a California limited liability company's legal name and address, 2108 N Street, Suite N, Sacramento, CA 95816, along with a link to the Billing & Refund Policy.

10. SMS, email, and push notifications

If you opt in to text messages, you will receive account and job-related messages, such as a new lead, a new message, or a job update. We do not send third-party marketing texts. Message and data rates may apply, and message frequency varies. Reply STOP to any text to opt out, or HELP for help. Agreeing to receive texts is never a condition of purchasing anything from us. Full details are in our separate SMS Terms.

We send transactional email for account and job notices (receipts come directly from Stripe), a monthly home digest, and occasional product update emails. Every email includes our mailing address and an unsubscribe link. Opting out stops digest and product emails; transactional emails about your account and active jobs continue even after you opt out, because they are necessary to run the service.

Push notifications require your browser or device permission and can be turned off at any time in your settings.

11. Prohibited conduct

You agree not to:

Violating this section can result in content removal, account suspension, or termination as described in section 14.

12. Intellectual property, DMCA, and feedback

OakTend's software, design, trademarks, and branding belong to OakTend LLC, a California limited liability company or our licensors. These Terms do not grant you any right to use our trademarks or branding without our written permission.

If you believe content on OakTend infringes your copyright, use our DMCA takedown process, described on our DMCA page, which names our designated agent and the notice-and-takedown procedure required under 17 U.S.C. Section 512. We maintain a policy of terminating repeat infringers' accounts in appropriate circumstances.

If you send us feedback, suggestions, or ideas about OakTend, you give us a perpetual, irrevocable, royalty-free license to use them without any obligation to you, unless we agree otherwise in writing.

13. Third-party services

OakTend relies on third-party services to operate, including Supabase (authentication, database, and file storage), Vercel (hosting), Stripe (payments and subscriptions), Twilio (SMS delivery), Resend (email delivery), Anthropic (the Claude models behind Ask OakTend), RentCast (property and value data), Photon/OpenStreetMap (address autocomplete), the CSLB public license database, and, for pros who use it, Checkr (background checks). Our Privacy Policy describes what each of these receives.

OakTend may also link to third-party websites or contain content from third parties. We do not control and are not responsible for third-party sites, services, or content. Your use of any third-party service is governed by that service's own terms.

14. Termination and suspension

By you. You can delete your own account at any time from Account > Privacy in the app. Deletion is described in our Privacy Policy.

By us. We may suspend or terminate your account if you violate these Terms, our Community Guidelines, or the law, or if we reasonably believe your account poses a risk to OakTend or other users. Where practical, we will tell you why.

Effect of termination. If we terminate your account for a violation, any account credit or promotional credit in your account is forfeited; it was never cash and is not refundable or transferable. Data handling after termination, including what we keep and for how long, is governed by our Privacy Policy.

15. Disclaimers

OakTend is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy, completeness, or usefulness of any Ask OakTend answer, cost estimate, home value estimate, license or insurance trust signal, or review. We do not warrant the quality, licensing status, insurance, legality, safety, or outcome of any pro's work, or that any job posted by a homeowner is genuine.

To the extent the law allows, we disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states and countries do not allow the exclusion of implied warranties, so this section may not apply to you in full.

Disputes with other users and work at your home. Pros come to homeowners' properties and homeowners let pros into their homes. OakTend does not screen either side beyond the trust signals in section 5, is not present for the work, and cannot control how any user behaves. If you have a dispute with another user, or a pro's work or a homeowner's conduct causes you loss, injury, or damage, your claim is against that user, not against OakTend. To the extent the law allows, you release OakTend LLC, a California limited liability company and its members, managers, officers, employees, and agents from claims, demands, and damages of every kind arising out of or connected with a dispute between users or with work performed at a property. You waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." This release does not cover claims based on OakTend's own fraud, willful misconduct, or violation of law, and does not limit anything section 16 says we cannot limit.

16. Limitation of liability

To the extent the law allows, OakTend is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, even if we were told those losses were possible.

To the extent the law allows, OakTend's total liability to you for any claim arising out of your use of OakTend is capped at the greater of $100 or the amounts you paid to us in the 12 months before the claim.

Nothing in this section limits our liability for our own fraud, for willfully injuring you, or for anything California Civil Code section 1668 does not let us limit by contract. If a court finds any part of this section unenforceable as to a particular claim, only that part is limited or removed for that claim, and the rest of this section still applies. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold OakTend harmless from any claim, loss, liability, or expense, including reasonable attorneys' fees, arising out of your violation of these Terms, your content, your use of OakTend, or your interaction with another user or a job, except to the extent the claim arises from OakTend's own violation of law, fraud, or willful misconduct.

18. Dispute resolution: informal process and binding arbitration

Please read this section carefully. It affects your legal rights.

Step one: tell us first. Before either of us starts an arbitration, the side with the complaint sends the other a written notice describing the problem and what would resolve it. Send yours to legal@oaktend.com. We will do the same for you, at the email on your account. Both sides then have thirty (30) days to try to resolve it in good faith. Neither side may file an arbitration or a lawsuit until those thirty (30) days have passed. This requirement applies to us too, not just to you.

Binding individual arbitration. If we cannot resolve a dispute informally, you and OakTend agree that it will be resolved by binding, individual arbitration, not in court and not in front of a jury. This covers disputes about these Terms, your account, fees, Ask OakTend, content, and your use of OakTend generally, under any legal theory. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules, or by the American Arbitration Association under its Consumer Arbitration Rules, at your election, in effect when the claim is filed. The Federal Arbitration Act governs whether this section is enforceable. Arbitration will take place in Orange County, California, or, at your option, by video or telephone. We will pay any arbitration fees that the applicable consumer arbitration rules require us to pay.

Class action and jury waiver. You and OakTend each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator has no authority to preside over a class or representative proceeding. Both of us waive any right to a jury trial for claims subject to this section.

Mass filings. If many similar demands are filed at once, the arbitration provider's own mass arbitration rules apply as written. We do not impose any extra batching, bellwether, or fee procedure of our own.

How to opt out. You may opt out of this entire arbitration section by emailing legal@oaktend.com within thirty (30) days of the date you first agree to these Terms, stating clearly that you want to opt out of arbitration and including your name and the email address on your OakTend account. Opting out does not affect any other part of these Terms and does not affect your access to OakTend.

What is not covered. Either of us may bring a qualifying claim in small claims court instead of arbitration, as long as it stays there and stays individual. A claim for public injunctive relief, meaning relief whose primary purpose is stopping unlawful conduct that threatens the general public rather than obtaining relief for you individually, is not subject to this arbitration agreement and may proceed in the court named in section 19, consistent with McGill v. Citibank, N.A.

Severability. If a court finds the class action waiver in this section unenforceable as to a particular claim, then that claim, and only that claim, will proceed in court rather than arbitration, while the rest of this section, including the requirement to arbitrate all other claims, remains in effect. If any other part of this section is found unenforceable, that part is severed and the rest remains in force.

This section survives the termination of your account and of these Terms.

19. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs section 18. For any dispute that is not resolved through arbitration, you and OakTend agree that the state and federal courts located in Orange County, California have exclusive jurisdiction, and each of us consents to that jurisdiction and venue.

20. Apple App Store terms

If you downloaded the OakTend app from Apple's App Store, this section also applies, and Apple Inc. is a third-party beneficiary of these Terms with the right to enforce them against you.

These Terms are between you and OakTend, not Apple. Apple has no obligation to provide maintenance or support for the app. In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar law. Apple is not responsible for investigating, defending, settling, or discharging any claim that the app or your possession or use of it infringes a third party's intellectual property rights.

You agree to comply with all applicable third-party terms when using the app, including Apple's Media Services Terms and Conditions. You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.

21. Changes to these terms

We may update these Terms as OakTend changes. For a material change, we will give you notice by email to the address on your account or a notice inside the app, at least thirty (30) days before the change takes effect, and we will update the "Last updated" date at the top of this page. Continuing to use OakTend after a material change takes effect means you accept it. We may make non-material changes, such as clarifications or fixing a typo, without separate notice.

If a change affects section 18, you get a fresh thirty (30)-day window to opt out of arbitration on the terms described there, measured from when we give you notice of that specific change. A change to these Terms never applies retroactively to a dispute or claim that either of us has already filed.

22. Miscellaneous

Entire agreement. These Terms, together with the documents they reference, including the Privacy Policy, the Pro Terms of Service (for pros), the Billing & Refund Policy, the SMS Terms, and the Community Guidelines, are the entire agreement between you and OakTend about your use of the service.

Assignment. You may not assign these Terms or your account without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.

No waiver. If we do not enforce a right under these Terms, that does not waive our ability to enforce it later.

Severability. If any part of these Terms is found unenforceable or invalid, that part is limited or removed to the minimum extent necessary, and the rest of these Terms stays in full effect. Section 18 has its own, narrower severability rule for the arbitration agreement; where the two overlap, that narrower rule controls for arbitration questions.

Force majeure. Neither of us is liable for a failure to perform caused by events beyond our reasonable control, such as natural disaster, act of government, power or internet outage, or a failure of a third-party service we rely on.

Electronic communications. You consent to receive communications from us electronically, including by email, text (if you opt in), and in-app notice, and you agree that these satisfy any legal requirement that a communication be in writing.

California Civil Code section 1789.3 notice. California users are entitled to the following consumer rights notice: the provider of this service is OakTend LLC, a California limited liability company, mailing address 2108 N Street, Suite N, Sacramento, CA 95816, phone (714) 468-5480.
